【辭典】contingent base

【辭典】contingent base

http://en.wikipedia.org/wiki/Contingent_fee

A contingent fee (in the United States) or conditional fee (in England and Wales) is any fee for services provided where the fee is only payable if there is a favourable result. In the law is defined as "[a] fee charged for a lawyer's services only if the lawsuit is successful or is favorably settled out of court...Contingent fees are usually calculated as a percentage of the client's net recovery."[1].

In the English legal system is generally referred as No win no fee. Being this a conditional fee agreement between a law firm and a client. The usual form of this agreement is that the solicitor will take a law case on the understanding that if lost, no payment is done.

However if the case is won the lawyer will be entitled to his normal fee based on hourly billing, plus a success fee. The success fee in England must be as a percentage no greater than 100% of the normal fee, provided this contrasts with the contingency fee in the USA which gives the successful attorney a percentage of the damages awarded in favor of his client.

Definition: Subject matter is what something is about.

In artwork, the subject matter would be what the artist has chosen to paint, draw or sculpt. In patent law, the subject matter would be the technical content of a patent or patent application found in the description, claims and drawings.

In other words, subject matter is what the inventor has choosen to invent, and in a patent application the inventor must reveal the subject matter (invention) in a way dictated by law.

Examples:

Example 1 : The specification must conclude with a claim particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention or discovery.

Example 2 : The distinction between patentable and unpatentable subject matter continues to be a topic of debate among software developers, academics, lawyers, and USPTO examiners.

Example 3 : The patented subject matter, and additional subject matter still pending in the US and foreign patent offices, includes claims to methods and devices for delivering medicinal substances to the interior of cells in various body tissues.

Double Patenting

Double Patenting
The double patenting doctrine generally prevents a patentee from receiving two patents for the same invention. Thus, this doctrine polices the proper application of the patent term for each invention. The proscription against double patenting takes two forms: statutory and non-statutory. Statutory, or “same invention,” double patenting is based on the language in § 101 of the Patent Act mandating “a patent” for any new and useful invention. 35 U.S.C. § 101 (2000); In re Goodman, 11 F.3d 1046, 1052 (Fed. Cir. 1993) (“If the claimed inventions are identical in scope, the proper rejection is under 35 U.S.C. § 101 because an inventor is entitled to a single patent for an invention.”) (citations omitted). Non-statutory, or “obviousness-type,” double patenting is a judicially created doctrine adopted to prevent claims in separate applications or patents that do not recite the “same” invention, but nonetheless claim inventions so alike that granting both exclusive rights would effectively extend the life of patent protection. Gerber Garment Tech., Inc. v. Lectra Sys., Inc., 916 F.2d 683, 686 (Fed. Cir. 1990) (citing In re Thorington, 418 F.2d 528, 534 (CCPA 1969)). This case involves double patenting in this latter category.

subject matter jurisdiction(事物管轄權):具有裁判該種類案件的權限
personal jurisdiction(人的管轄權):具有對該案件及當事者進行裁判的權限

A nonexclusive patent license is simply a promise not to sue for infringement. See Rite-Hite Corp. v. Kelley Co., 56 F.3d 1538, 1552 (Fed. Cir. 1995) (en banc); Spindelfabrik Suessen-Schurr Stahlecker & Grill GmbH v. Schubert & Salzer Maschinenfabrik Atkiengesellschaft, 829 F.2d 1075, 1081 (Fed. Cir. 1987). The conveyance of such a license does not obligate the licensee to do anything; it simply provides the licensee with a guarantee that it will not be sued for engaging in conduct that would infringe the patent in question.

(Negative Doctrine of File Wrapper Estoppel)

(Negative Doctrine of File Wrapper Estoppel)

(MORGAN ENVELOPE CO v. ALBANY PERFORATED WRAPPING PAPER CO., 152 U.S. 425 (1894))!

The judicial doctrine of assignor estoppel prevents the assignor of a patent from later contending that the patent is invalid.
On appeal, the CAFC agreed that the court had correctly excluded the inventor’s testimony because it would be “unfair” to allow the inventor to testify against the patent.

A shop right is an employer’s non-exclusive, royalty-free, non-transferable license to make, use and sell items embodying an employee’s patentable invention, but only within the normal scope of its business. A shop right doesn’t automatically arise, however. It typically exists only where an employee has used the employer’s time, materials or equipment in creating the patented invention. A shop right can last beyond the employee’s term of employment, but expires along with the patent at the end of its 20 year term. Technically, a shop right is not an ownership right in the patent, but is a defense against an employee’s allegation of patent infringement.

Without prejudice to

  • Without prejudice to section 24, the following shall be treated as properly executed
  • Without prejudice to your powers and discretions, we hereby authorize you or your agents to take any actions including but not limited to the following:
  • Without prejudice to the rights of the Attorney General every complainant or informant shall be at liberty to conduct the complaint or information respectively and to have the witnesses examined and cross-examined by him or by counsel on his behalf.

審查標準分成:"de nove" 、"clearly erroneous standard"、 "arbitrary and capricious standard"、以及"substantial evidence standard" reviews。

關於法律問題適用"de nove" reviews,上級法院完全不採用下級法院的判斷來進行審查;

"arbitrary and capricious standard"

While the ultimate determination of obviousness is a legal conclusion reviewed by this court without deference, that determination always entails various factual findings that this court reviews for clear error following a bench trial. See Weatherchem Corp. v. J.L. Clark, Inc., 163 F.3d 1326, 1332 (Fed.
